On April 22, 2026, an appeal was filed in a federal appeals court in the NRB v. case, challenging the Johnson Amendment's limits on churches' political speech. This follows Judge Campbell Barker of the US District Court for the Eastern District of Texas dismissing a proposed agreement on April 16 that would have allowed churches to endorse political candidates without losing their tax-exempt status. The judge rejected a proposed settlement in the long-running lawsuit filed by the National Religious Broadcasters (NRB) and two Texas Baptist churches, stating the court had no authority to approve the agreement. Earlier, on March 31, 2026, Judge Barker ruled he lacked the authority to approve a proposed settlement between the Internal Revenue Service and the plaintiffs, which aimed to ease political-speech limits for churches by affecting the Johnson Amendment.
