WP Engine Accuses Automattic of Destroying Evidence, Asks Court to Dismiss Trademark Counterclaims

WP Engine has asked a federal court to sanction Automattic and CEO Matt Mullenweg, alleging they destroyed evidence and repeatedly misrepresented their efforts to preserve it. In a 29-page motion filed on Tuesday in the U.S. District Court, WP Engine claims that Mullenweg’s WhatsApp, Signal, and Telegram messages from the September 2024 events at the heart of the ongoing dispute were not preserved, and that Automattic’s lawyers told WP Engine and the court the messages were safe when they were not.
