The Federal Court of Appeal addressed the preferable procedure criterion in the context of a defendants' class proceeding in *Voltage Pictures v Robert Salna* 2025 FCA 131. Plaintiffs sought to certify an action against a class of defendants and impose the burden on Mr. Salna to represent the defendant group. On July 16, 2025, the Court dismissed, for a second time, the studios' appeal for certification of a proposed class of unknown individual defendants in *Voltage Pictures v Robert Salna* (Voltage FCA #2). The Court also ruled that cases where IP addresses are the main initial evidence are unsuited to a reverse class action approach, permanently shutting down the studios' strategy to sue alleged BitTorrent pirates in Canada. The Court further reviewed the notice and notice regime in the Copyright Act within the same case, addressing whether Voltage could use this regime to serve certification notices under its proposed reverse copyright class action.
